Terms of Service

These Terms of Service ("Terms") govern your access to and use of PromptRank (the "Service"), operated by Golden Ace Holdings LLC, a Florida limited liability company ("PromptRank", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PromptRank queries third-party AI models to estimate how often and how prominently a business is mentioned in their responses, and returns a score and related analysis. Results are estimates based on AI model outputs, which are probabilistic and change over time. We do not guarantee accuracy, completeness, or any particular outcome.

2. Accounts

You are responsible for safeguarding your account credentials and for all activity under your account. You must provide accurate information and be at least the age of majority in your jurisdiction.

3. Plans, billing, and refunds

  • Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe.
  • You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period.
  • Except where required by law, payments are non-refundable.
  • Usage limits apply per plan and may be enforced automatically.

4. Acceptable use

You agree not to misuse the Service, including by attempting to:

  • circumvent usage limits, rate limits, or access controls;
  • reverse engineer, scrape, or resell the Service without permission;
  • use the Service for unlawful, deceptive, or abusive purposes.

5. Third-party AI providers

The Service relies on third-party AI providers (including OpenAI, Anthropic, Google, xAI, and DeepSeek). Their availability, behavior, and outputs are outside our control, and your use may be subject to their terms.

6. Intellectual property

The Service, including its software, design, and branding, is owned by us and protected by applicable laws. Reports we generate for you are yours to use for your own business purposes.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that results will improve any business outcome.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

9. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.

10. Changes

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use after changes means you accept the revised Terms.
